Assumed Names/Starting a Business
On December 1, 2017, the Assumed Names Law (also known as “doing business as”) changed. Read the Assumed Business Name (Session Law 2017 – 23, House Bill 228) Filings of assumed names are still made at the Register of Deeds office. Some key advantages to the new statue are:
- Filing in Guilford County can cover all NC counties (or those you choose)
- You can register up to five names on one form
- Filings no longer have to be notarized.
All assumed names filed before December 1, 2017 will need to be refiled by December 1, 2022 or they will expire. We recommend filing early so that it is in the new system and there is no lapse.
The Register of Deeds handles filings for sole proprietorships, partnerships, corporations (doing business under an assumed name), and limited liability companies (LLCs) doing business under an assumed name.
The filer is responsible for researching the name for availability in Guilford County. To obtain a Certificate of Assumed Name form, visit the Business Link NC website at http://www.blnc.gov. The form that you select must be completed in accordance with NCGS 161-14. Submit the completed form to the Register of Deeds office for recordation. The recording fee per NCGS 161-10 is $26.00 for the first 15 pages, $4.00 for each additional page thereafter.
